Rule R414-514 - Requirements for Moratorium Exception
Section R414-514-2 - Requirements for Additional Nursing Care Facility Programs or Additional Beds Within an Existing Program

(1) A Medicaid-certified nursing care facility program shall meet the requirements of Section 26B-3-311 to acquire additional nursing care facility programs or to acquire additional beds.

(2)

(a) Pursuant to Subsection 26B-3-311(5), a nursing care facility program shall provide necessary information on the application for the Utah Medicaid Nursing Facility Moratorium Exception.

(b) The Division of Integrated Healthcare (DIH) shall return the application and provide notice to the requestor if the application or supporting documentation is deficient.

(3) The notice date for the notice under Subsection (2)(b) is the date the application is sent via email. Applications must be emailed to DIH at qii@utah.gov.

(a) If DIH receives an application described in Subsection (2) from a facility in a rural county, and a Medicaid-certified nursing facility program does not meet the quality standards pursuant to Subsection 26B-3-311(5)(d)(v), the certified program may provide additional information under Subsection 26B-3-311(9)(a)(ii).

(b) Any additional information submitted to DIH must be emailed within 14 days of the original notice from DIH.
