Rule R307-401 - Permit: New and Modified Sources
Section R307-401-3 - Applicability

(1) Rule R307-401 applies to any person planning to:
(a) construct a new installation
that will or might reasonably be expected to be a source or an indirect source
of air pollution;
(b) make
modifications to or relocate an existing installation that will or might
reasonably be expected to increase the amount of or change the character or
effect of air pollutants discharged, so that the installation may be expected
to be a source or indirect source of air pollution; or
(c) install an air cleaning device or other
equipment intended to control emission of air pollutants.
(2) Rules R307-403, R307-405 and R307-406 may establish additional permitting requirements for new or modified sources.
(a) Exemptions contained in Rule R307-401 do
not affect applicability or other requirements under Rules R307-403, R307-405
or R307-406.
(b) Exemptions
contained in Rules R307-403, R307-405 or R307-406 do not affect applicability
or other requirements under Rule R307-401, unless specifically authorized in
this rule.
