Section R270-1-6 - Attorney Fees

(1) Pursuant to Subsection 63M-7-524(2), the office shall award attorney fees within the reparation award and not in addition to the award.
(2)
(a) If the office pays an award in a lump
sum, the attorney's fee may not exceed 15% of the total award
(b) If payments are awarded on an ongoing
basis, the office shall pay attorney fees when warrants are generated but not
to exceed 15%.
(3) When award denials are overturned, attorney fees shall be calculated only on the appealed reparation issue.
