Section R156-55a-305a - Exempt Contractors Filing Affirmation of Liability and Workers' Compensation Insurance

(1) Under Subsection 58-55-305(1)(h)(ii)(H), a person claiming exemption under Subsection 58-55-305(1)(h) for projects with a value greater than $1,000 but less than $3,000 shall file a registration of exemption with the Division that includes:
(a) the identity and address of the person
claiming the exemption;
(b) answers
to qualifying questions; and
(c) a
statement signed by the person verifying that:
(i) the person has liability insurance in
force that includes:
(A) the Division named as
a certificate holder;
(B) the
policy number, the expiration date of the policy, the insurance company name
and contact information, and coverage amounts of at least $100,000 for each
incident and $300,000 in total; and
(ii) that the person:
(A) has workers' compensation insurance in
force that names the Division as a certificate holder, includes the policy
number, the expiration date of the policy, the insurance company name and
contact information; or
(B) that
the person does not hire employees and is therefore exempt from the requirement
to have workers' compensation insurance.
(2) The affirmation required under Subsection (1) shall be reaffirmed on or before November 30 of each odd numbered year.
