(a) If the department receives information that provides reasonable cause to believe that the firm has become ineligible to be certified as an SBE, other than information provided by a challenger under § 9.311 of this subchapter (relating to Certification Challenges), the department will provide a written notice to the firm proposing to find the firm ineligible and stating the reasons for it.
(b) The department will give the firm an opportunity to present information and arguments in writing concerning its eligibility.
