Transportation Code, Chapter 202, Subchapter E, authorizes the department to enter into a lease or other agreement with a telecommunications provider to allow the provider to place its telecommunications facilities on department right of way or to use facilities owned by the state. This subchapter prescribes the policies and procedures governing access by an agreement other than a lease.
