Section 730.301 - Petition for Proposed Rulemaking

(a) Any individuals or groups, including department employees, may submit a rule for consideration by the Texas Department of Protective and Regulatory Services (PRS). Rulemaking petitions must be in the form of a letter that is addressed to Texas Department of Protective and Regulatory Services, Policy and Document Support--MC E-503, 701 West 51st Street, P.O. Box 149030, Austin, Texas 78714-9030, and that contains the following information:

(1) a brief explanation of the proposed rule;

(2) the text of the proposed rule, in the exact form proposed for adoption;

(3) a statement of the statutory or other authority under which the rule is to be promulgated;

(4) a suggested date of adoption;

(5) the public benefit anticipated as a result of adopting the rule;

(6) the petitioner's name, mailing address, and telephone number; and

(7) the petitioner's signature.

(b) Within 60 days after the postmark date of the envelope containing the petition, PRS will either initiate the rulemaking procedures or deny the petition and state the reasons for denial in writing.
