Part 19 - DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES
Chapter 700 - CHILD PROTECTIVE SERVICES
Subchapter J - ASSISTANCE PROGRAMS FOR RELATIVES AND OTHER CAREGIVERS
Division 2 - PERMANENCY CARE ASSISTANCE PROGRAM
Section 700.1045 - If no assistance is needed at the time a person becomes the permanent kinship conservator, can that person still enter into a permanency care assistance agreement?

Current through Reg. 49, No. 38; September 20, 2024

Yes. If a prospective permanent kinship conservator meets the eligibility criteria for permanency care assistance, but does not need any monetary assistance or Medicaid to meet the child's needs at the time the court awards permanent managing conservatorship of the child, that person may enter into a deferred permanency care assistance agreement to preserve eligibility to receive permanency care assistance benefits for the child in the future, should the need arise.
