Section 700.311 - Eligible Individuals

(a) Children and their families are eligible for services to prevent abuse and neglect and to avoid having to remove children from their homes, services to remove children in danger of harm, and services to reunify families when both of the following two conditions are satisfied.

(1) Child Protective Services (CPS) determines that there is a reasonable likelihood that a child will be abused or neglected in the foreseeable future. CPS bases this determination on the statutory definitions of child abuse and neglect in the Texas Family Code, § 261.001.

(2) The case meets the criteria for providing services in at least one of the following sections and subchapters:
(A) §700.515 of this title (relating to Providing Immediate Protection);

(B) Subchapter G of this chapter (relating to Services for Families);

(C) Subchapter K of this chapter (relating to Court-Related Services); and

(D) Subchapter M of this chapter (relating to Substitute-Care Placement Services.

(b) CPS staff must redetermine each client's eligibility for services at least every six months through the case planning process.
