Section 700.201 - Purpose

The purpose of this subchapter is to clarify to whom and under what circumstances the Texas Department of Protective and Regulatory Services (TDPRS) may disclose information made confidential under § 261.201 of the Texas Family Code. These rules apply to those investigations carried out under § 261.301(a) of the Texas Family Code. The rules in this subchapter do not apply to the release of information relating to an investigation of abuse or neglect alleged to have occurred in a facility as described in § 261.301(b) of the Texas Family Code, nor to the release of information from TDPRS's Central Registry, as described under § 261.002 of the Texas Family Code. Additional policy safeguards may be developed by TDPRS as needed to ensure the proper implementation of these rules in specific cases.
