(a) Subject to the Texas Public Information Act, Government Code, Chapter 552, all information collected, assembled, or maintained by the board are public records open to inspection and copying during regular business hours.

(b) A person submitting data or information to the board may request the data or information be designated as classified or confidential under an exception to the Public Information Act. If the executive administrator agrees with the designation, the data or information is not open for public inspection and shall be kept in confidence by the agency. If such information is requested by any other person, the executive administrator shall comply with the provisions of the Public Information Act, which may require disclosure of the information.
