If a person or entity fails to comply with the terms of this chapter, the executive director may require the entity to apply for and obtain a permit or permit amendment. The commission may also issue an enforcement order requiring remedial measures and the assessment of administrative penalties pursuant to § 26.019 and § 26.136 of the Texas Water Code. The commission may also seek civil penalties and injunctive relief in a court of competent jurisdiction as provided by §26.123 of the Texas Water Code.
