Section 743.105 - What are the background check requirements?

(a) Shelter care operations must comply with the background check requirements found in Subchapter F of Chapter 745 of Title 40 (relating to Background Checks).

(b) You do not have to submit a request for a background check on a person 14 years of age or older who resides at the shelter, as required by § 745.605(a)(6)(A) of Title 40 (relating to For whom must I submit requests for background checks?), unless the person is otherwise required to have a background check under § 745.605(a). For example, you must request a background check for a person who resides at the shelter if the person is a caregiver at the operation.
