Section 711.1425 - May an employee withdraw a Request for EMR Hearing after it is filed?

Yes. An employee may withdraw a Request for EMR Hearing any time before the hearing is conducted. An employee who withdraws a Request for EMR Hearing will be deemed to have accepted the finding of reportable conduct and HHSC will submit the employee's name for inclusion in the EMR.
