Section 307.131 - Compliance with Statutes, Rules, and Other Documents

(a) In addition to any applicable federal or state law or rule, a JBCR program must comply with:
(1) Texas Health and Safety Code Chapter 574
(relating to Court-Ordered Mental Health Services);
(2) Texas Human Resources Code Chapter 48
(relating to Investigations and Protective Services for Elderly Persons and
Persons with Disabilities);
(3) 26
TAC:
(A) Chapter 301, Subchapter G of this
title (relating to Mental Health Community Services Standards);
(B) Chapter 301, Subchapter H of this title
(relating to Deaths of Individuals Served by Community Mental Health
Centers);
(C) Chapter 306,
Subchapter A of this title (relating to Standards for Services to Individuals
with Co-occurring Psychiatric and Substance Use Disorders (COPSD));
(D) Chapter 320, Subchapter A of this title
(relating to Rights of Individuals Receiving Mental Health Services);
(E) Chapter 320, Subchapter C of this title
(relating to Interventions in Mental Health Services);
(F) Chapter 320, Subchapter D of this title
(relating to Prescribing of Psychoactive Medication); and
(G) Chapter 334 of this title (relating to
Rights of Individuals with an Intellectual Disability).
(b) Concerning confidentiality, a JBCR program must comply with the Health Insurance Portability and Accountability Act, 42 U.S.C. § 1320d et seq and other applicable federal and state laws, including:
(1) 42 CFR Part 2 and Part 51, Subpart
D;
(2) 45 CFR Parts 160 and 164,
and Part 1326, Subpart C;
(3) Texas
Health and Safety Code Chapter 81, Subchapter F;
(4) Texas Health and Safety Code Chapters
181, 595, and 611;
(5) Texas Health
and Safety Code §§
533.009,
576.005,
576.007, and
614.017;
(6) Texas Government Code Chapters 552 and
559;
(7) Texas Occupations Code
Chapter 159; and
(8) Texas Business
and Commerce Code §
521.053.
