Section 307.109 - Service Standards

A JBCR program must:

(1) use a multidisciplinary treatment team focused on the objective of restoring the individual to competency to stand trial;

(2) employ or contract for the services of at least one psychiatrist;

(3) provide JBCR through licensed professionals, QMHP-CSs, or QIDPs as permitted by their professional license or credentials;

(4) provide weekly competency restoration hours commensurate to the treatment hours provided as part of a competency restoration program at an inpatient mental health facility;

(5) provide JBCR in a designated space in the jail, separate from the space used for the general population of the jail;

(6) ensure coordination of general health care;

(7) provide mental health treatment, SUD treatment, and referral to ID services to individuals, as clinically indicated, for competency restoration;

(8) supply clinically appropriate psychoactive medications for purposes of administering court-ordered medication to individuals as applicable and in accordance with Texas Code of Criminal Procedure Article 46B.086 or Texas Health and Safety Code § 574.106; and

(9) assess individuals for suicidality and homicidality and develop a safety plan based on the needs of the individual.
