Section 306.192 - Transfers Between a State Mental Health Facility and a State Supported Living Center

(a) For an individual transferring from a state mental health facility (SMHF) to a state supported living center (SSLC) :

(1) the following rules and statutes govern the transfer:
(A) 40 TAC Chapter 2, Subchapter F, Division 3 (relating to Transfers); and

(B) Texas Health and Safety Code § 575.013 and § 575.017; and

(2) the SMHF must not transfer the individual before the judge of the committing court enters an order approving the transfer.

(b) For an individual transferring from an SSLC to an SMHF:

(1) Section 902.1 of this title (relating to Transfer of an Individual from a State Supported Living Center to a State Hospital) and Texas Health and Safety Code § 594.034 govern the transfer; and

(2) the receiving SMHF notifies the designated local mental health authority or local behavioral health authority or the designated local intellectual and developmental disability authority of the transfer.
