Section 270.20 - Right to Appeal

(a) Internal appeal.
(1) Any client who is denied program
services is entitled to an appeal through the provider agency.
(2) If the client also chooses to file an
external appeal, the provider agency must assist the client in filing an
external appeal.
(b) External appeals. Any client covered by:
(1)
Medicaid may file an appeal through the Texas Medicaid hearing process;
or
(2) Medicare, but not Medicaid,
may file an appeal through the Centers for Medicare and Medicaid Services
hearing process.
