Section 414.408 - Patients Committed to Mental Health Facilities under Provisions Other than Those Found in the Texas Health and Safety Code (i.e., Code of Criminal Procedure, Family Code)

(a) The decision to administer medication to a patient committed to a TDMHMR mental health facility under provisions other than THSC §574.034 or §574.035 must be is consistent with the holding in Sell v. United States, 123 S.Ct.2174 (2003).

(b) Nothing in this section is intended to preclude the administration of psychoactive medication to any patient in a psychiatric emergency as provided for in § 414.410 of this title (relating to Psychiatric Emergencies).
