Section 231.3 - Request for Official Determination

(a) On receipt of a written request regarding the applicability to a specific circumstance of a rule or the requirements for compliance with the rule, the Department of State Health Services (department) will provide an official written determination regarding the applicability of the rule or the requirements for compliance with the rule to the requestor not later than the 30th day after the date the department receives the request.
(b) An official determination made under this section is valid until the rule that is the subject of the determination is amended by statute or department rule.
(c) In order to ensure the accuracy and applicability of the determination, all written requests for official determination should be submitted on a form available from the department and should be completed in its entirety. The form is available from the department's website at http://www.dshs.state.tx.us/ .
