Section 10.218 - Additional Requirements

(a) Forfeiture and Return of Funds.
(1) Each grantee shall
return any award funds remaining unspent at the end of the grant term as set
forth in the RFA or Notice of Grant Agreement (NOGA) to the Coordinating Board
within ninety (90) calendar days after written request or an earlier due date
if specified by the RFA.
(2) Each
grantee shall return or repay to the Coordinating Board any award funds that
the State determines an eligible institution improperly expended on items not
listed in the RFA or otherwise prohibited by law within the time frame and
subject to the requirements set forth in the RFA.
(b) The Commissioner may take the following actions if a grantee fails to comply with requirements set forth in the RFA:
(1) Reduce the grant award;
(2) Require the grantee to return unspent
grant funds;
(3) Amend the grant
agreement; or
(3) Terminate the
grant agreement.
(c) The RFA may set forth additional return or reimbursement of fund requirements and termination provisions.
(d) The Coordinating Board may retain returned and reimbursed funds for award in a future year as authorized by the General Appropriations Act.
