Section 7.7 - Title to Materials

(a) In accordance with state statutes concerning public records, to guarantee continuity of responsibility for the materials transferred to the commission, and to provide statewide uniformity in their administration, title to all materials given, donated, or transferred to the commission and placed in a depository shall reside in the commission, except as provided by § 7.10 of this subchapter (relating to Application for Transfer of Title to Local Historical Resources).

(b) Historical resources may be accessioned, and accessions negotiated, only by commission staff members. However, depository staff may, on request and authorization of the commission, physically transport to a depository historical resources which have previously been accepted by commission staff.
