Section 372.501 - Disqualifications Due to Criminal Activity

(a) In TANF, a person is disqualified from receiving benefits if the Texas Health and Human Services Commission (HHSC) determines the person:
(1) is a fugitive (a person fleeing to avoid
prosecution or confinement for a felony criminal conviction, or found by a
court to be violating federal or state probation or parole); or
(2) is convicted of a felony drug offense
(not deferred adjudication) in Texas or another state committed on or after
April 1, 2002.
(b) In SNAP, a person is disqualified from receiving benefits as follows :
(1) the person is disqualified from receiving
SNAP benefits if HHSC determines the person is a fugitive (a person fleeing to
avoid prosecution or confinement for a felony criminal conviction, or found by
a court to be violating federal or state probation or parole); or
(2) the person is disqualified from receiving
SNAP benefits for two years if HHSC determines the person is convicted of a
felony drug offense (not deferred adjudication) in Texas or another state on or
after September 1, 2015, and has violated his or her parole or community
supervision; or
(3) the person is
disqualified from receiving SNAP benefits permanently if HHSC determines the
person is convicted of a felony drug offense (not deferred adjudication) in
Texas or another state on or after September 1, 2015, and, while receiving SNAP
benefits, the person is convicted of a subsequent felony drug offense (not
deferred adjudication) in Texas or another state.
