Section 363.301 - Purpose

(a) The purpose of this subchapter is to establish rules for private duty nursing services under the federal Early and Periodic Screening, Diagnosis, and Treatment (EPSDT) Program, known in Texas as the Texas Health Steps - Comprehensive Care Program (THSteps-CCP).

(b) EPSDT recipients are entitled to all medically necessary EPSDT services that:

(1) correct or ameliorate defects and physical and mental illnesses and conditions; and

(2) are eligible for federal financial participation.

(c) This subchapter applies to Medicaid fee-for-service (FFS) and Medicaid managed care organizations (MCOs) that are contracted with HHSC to provide Medicaid services.
