Section 251.12 - Commission and Regional Planning Commission Contracts for 9-1-1 Service

(a) Purpose. The purpose of this rule is to implement the requirement in Health and Safety Code § RSA 771.078 that the Commission adopt by rule the standard provisions for a contract between the Commission and a Regional Planning Commission (RPC) to provide 9-1-1 service .

(b) Per Health and Safety Code § RSA 771.078(c), a contract under this section must provide for:

(1) the reporting of financial information regarding administrative expenses in accordance with generally accepted accounting principles;

(2) the reporting of information regarding the current performance, efficiency, and degree of implementation of emergency communications services in an RPC's 9-1-1 service area;

(3) the collection of efficiency data on the operation of 9-1-1 answering points;

(4) standards for the use of and the creation of new public safety answering points;

(5) quarterly disbursements of money due under the contract, except as provided by paragraph (6) of this subsection;

(6) the Commission to withhold disbursement to an RPC that does not follow a standard imposed by the contract, a Commission rule, or a statute; and

(7) a means for the Commission to give an advance on a quarterly distribution under the contract to an RPC that has a financial emergency.

(c) Per Commission Program Policy Statement (PPS) Contracts for 9-1-1 Service, the Commission provides a standard form for contracts under this section.

(d) Per Commission PPS Regional Planning Commission Advance Quarterly Funding, the Commission provides advance funding to an RPC at the beginning of each fiscal quarter to fund operating costs attributable to providing 9-1-1 service.
