Section 0440-01-.14 - CIVIL PENALTIES

(1) The Tennessee State Board of Cosmetology and Barber Examiners may, in a lawful proceeding with respect to any person licensed or required to be licensed, in addition to or in lieu of any other lawful disciplinary action, assess civi l penalties for violation of statutes, rules or orders enforceable by the Board in accordance with the following schedule: Each individual act, and each day of continued violation, may constitute a separate violation. The amount of any civil penalty shall not exceed one thousand dollars ($1,000.00) for each violation.

(2) In determining the amount of any penalty to be assessed pursuant to this rule, the Board may consider such factors as the following:

(a) Willingness of the violation;

(b) Repetitions of the violation;

(c) Magnitude of the risk or harm caused by the violation; and

(d) Extent to which the licensee has sought to compensate any victim(s) of the violation.
