Section 0400-45-06-.13 - CLASS IV WELLS

Current through September 24, 2024

(1) The construction or operation of a well used for the disposal of any hazardous waste or radioactive waste into or above a USDW is prohibited.

(2) The operator or the owner of an existing Class IV well must, within six (6) months after the effective date of this rule, submit a Plugging and Abandonment Plan for the Commissioner's approval. The owner or operator of an existing Class IV well shall complete plugging and abandonment in accordance with the approved Plugging and Abandonment Plan not later than six (6) months after the Commissioner's approval of the plan.

(3) Wells used to inject contaminated ground water that has been treated and is being re-injected into the same formation from which it was drawn are not prohibited by this rule if such injection is approved by EPA or the Commissioner, pursuant to provisions for cleanup of releases under the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA), 42 U.S.C. 9601 - 9657, or pursuant to requirements and provisions under the Resource Conservation and Recovery Act (RCRA), 42 U.S.C. 6901 - 6987.
