(1) Definitions. As used in this rule,
(a) "Alcoholic Beverage"
means and includes intoxicating liquors, wine and beer, as defined by T.C.A.
§
57-3-101 and
T.C.A. §
57-5-101;
(b) "Institution Property" means property
owned or controlled by an institution governed by the Tennessee Board of
Regents.
(2) The possession and/or consumption of alcoholic beverages by students under the age of twenty-one (21) on institution property is absolutely prohibited.
(3) The possession and/or consumption of alcoholic beverages by students age twenty-one (21) and over on property owned or controlled by an institution governed by the Tennessee Board of Regents is prohibited except:
(a) Students who are at
least twenty-one (21) years of age may possess unopened containers of alcoholic
beverages within their personal vehicles, provided that they may not open the
containers or consume the contents while on institution property and the
alcoholic beverage must be stored out of plain sight. When the student is not
in the vehicle, the vehicle must remain locked.
(b) Students who are at least twenty-one (21)
years of age may consume alcoholic beverages at an event on institution
property for which the President has approved the serving and consumption of
alcoholic beverages by those invited to the event and to which the student is
an invited guest.
(4) Disciplinary Action
(a) Students violating
this rule and/or any related system or institution policy shall be subject to
discipline in accordance with the institution's disciplinary policy.
(b) Violation of this rule by students under
the age of twenty-one (21) shall be reported to campus law
enforcement.
(c) Except as
prohibited by the Family Educational Rights and Privacy Act (FERPA)

U.S.C. §
1232(g), the
institution shall notify a parent or legal guardian of a student under
twenty-one (21) years of age if the student has committed a disciplinary
violation with respect to the use or possession of alcoholic beverages on
institution property.
