The secretary may require any person authorized by a general permit to apply for and obtain an individual SWD permit. Any interested person may petition the secretary to take action under this section. Cases for which an individual SWD permit may be required include the following:

(1) The discharge is a significant contributor of pollution to waters of the state or it presents a health hazard;

(2) The discharger or treatment works treating domestic sewage is not in compliance with the conditions of the SWD general permit;

(3) A change has occurred in the availability of demonstrated technology or practices for the control or abatement of pollutants applicable to the point source;

(4) Effluent limitation guidelines are promulgated for point sources covered by the SWD general permit;

(5) A water quality management plan containing requirements applicable to such point sources is approved.
