The standards of performance for storage vessels of petroleum liquids constructed after June 11, 1973, and before May 19, 1978, are those in 40 C.F.R. § 60, Subpart K (July 1, 2018). A source that operates a unit subject to Subpart K is exempt from the obligation to obtain a Part 70 operating permit if the unit is not required to install controls and if the source is not required to obtain a Part 70 operating permit for a reason other than the source is subject to Subpart K . Exempted sources must still meet the applicable requirements in Subpart K.
