The agencies identified in subdivision 74:29:10:04(2) have 60 days from the date of receipt of a notice of intent to operate to submit to the department recommendations for nominating lands described in the notice for inclusion on the preliminary list of special, exceptional, critical, or unique lands. Such recommendations must be in writing and must comply with the requirements of § 74:29:10:16. Failure of an agency to respond within the 60 days constitutes that agency's clearance of the lands described in the notice for special, exceptional, critical, or unique characteristics.
