Following closure of the facility, the owner or operator shall record a notation on the deed to the property or on some other instrument that is normally examined during a title search. The owner or operator may request permission from the secretary to remove the notation from the deed if all wastes have been removed from the facility. The notation on the deed notifies any potential purchaser of the property that the land has been used as a solid waste facility and its use is restricted under § 74:27:15:02.
