A person proposing to construct a new Type I or IIA facility must submit a Phase I application for a solid waste permit at least 270 days before the proposed date on which construction of the facility is to begin. A person proposing to construct any other facility must submit an application for a solid waste permit at least 180 days before the proposed date on which construction of the facility is to begin. An additional 180 days may be required if an applicant is directed by the secretary to prepare an environmental impact statement (EIS) pursuant to SDCL 34A-9-4.
