Notwithstanding the provisions of SDCL 32-22-16 and 32-22-16.1, by application and permit only, a tractor-towed or truck-mounted stack mover built prior to July 1, 1992, and modified with a third axle, so that the combination of axles are spaced more than forty inches and less than eight feet apart, may have a triple axle weight of forty thousand pounds if the two axles are equipped with ten-inch dual tires and the third axle is equipped, as a minimum, with eight and one-quarter-inch dual tires. The third axle must have been installed prior to December 31, 1992. The application and permit must be accompanied by an affidavit affirming the dates of installation and manufacture as true and accurate. The exception to SDCL 32-22-16 and 32-22-16.1 provided for in this rule expires on June 30, 2008. However, a stack mover consisting of a minimum four axle group (not including the steering axle) that meets the requirements of this section may operate under the triple axle forty thousand pound allowance, in addition to the weight limitations as prescribed in SDCL 32-22-16 and 32-22-16.1 allowed for the fourth axle until June 30, 2012.

Failure to submit a complete and accurate stack mover application, operation of a stack mover without such permit, or operation of a stack mover not in conformance with this section shall result in application of the weight limitations as prescribed in SDCL 32-22-16 and 32-22-16.1.
