An applicant or recipient residing in a nursing or intermediate care facility is allowed a deduction of $60 a month to cover personal needs. An applicant or recipient with earned income is allowed an additional deduction for personal needs up to a maximum of the first $75 of gross earned income per month. An applicant or recipient who is paying court ordered child or spousal support is allowed an additional deduction for personal needs up to the amount of child or spousal support actually paid out, not to exceed the court ordered amount.

The provisions of this rule are applicable to applicants and recipients residing in a nursing facility or intermediate care facility.
