A home health agency must maintain a medical record for each individual receiving services. The medical record must contain documentation verifying that the claimed service was performed and was authorized by the attending physician or other licensed practitioner. The individual's medical record must be made available on request to the department, the Medicaid fraud control unit of the Attorney General's Office, or representatives of the United States Department of Health and Human Services. Medical records must be retained for six years.
