Section 67:11:01:01 - Petition for declaratory ruling

A person may file a petition for a declaratory ruling in accordance with SDCL 1-26-15 with the secretary of the department of social services. The secretary of social services shall issue a decision on the applicability of any statutory provision, rule, or order of the department of social services.

The petition shall contain all facts necessary to inform the secretary of social services of the ruling requested and it shall be signed by the person submitting the petition. A declaratory ruling shall be provided to the petitioner within thirty days after consideration by the secretary of social services.
