Except for §§ 67:10:07:06 and 67:10:07:10, the department must determine that the payee has mismanaged the assistance payment to such an extent that allowing the payee to continue managing the grant would be a threat to the health and safety of the child. Evidence of mismanagement may include any of the following:

(1) Failure to meet two or more rental or mortgage payments within the previous 14 months;

(2) Nonpayment of other bills;

(3) Persistent or deliberate failure to meet obligations for food, clothing, school supplies, or other essentials; or

(4) Continued expenditures for alcoholic beverages or other nonessentials.
