If a civil service employee was laid off, is rehired within one year after the employee's termination date, and has not received payment for unused sick leave pursuant to SDCL 3-6C-12, the employee is entitled to reinstatement of the sick leave that the employee had accrued at the time of termination. A person who voluntarily terminates employment is not entitled to a reinstatement of unused sick leave.
