A new claim filed by a claimant who received an eligible determination establishes the commencement of a benefit year, unless the claim is withdrawn within the appeal period. A claim may not be withdrawn after a determination denying benefits based on SDCL 61-6-9, 61-6-14, 61-6-15, or 61-6-16 is issued.
