Section 46:11:09:21 - Statement of deficiencies and plan of correction

If a qualified provider with a family support provider agreement fails to be in compliance, a statement of deficiencies noting areas of noncompliance shall be issued by the division within 30 calendar days following the survey. The qualified provider must submit a plan of correction to the division within 30 calendar days of receipt of the statement of deficiencies.

The plan of correction shall detail the action to be taken to correct the deficiencies and the date by which the corrections will be made. The plan of correction is subject to acceptance or rejection in whole or in part by the division. The division shall notify the qualified provider within 30 calendar days of receipt of the plan of correction of its decision regarding approval of the plan of correction and status of the provider agreement.
