The destruction of medication may only be done in accordance with the following requirements:

(1) Medications that are not controlled substances under SDCL 34-20B may be destroyed in the facility by a professional nurse and another witness or returned to the pharmacy; and

(2) Medications that are controlled substances under SDCL 34-20B must be destroyed in the facility, witnessed by two persons, both of whom are a nurse or pharmacist.

Each provider of direct HCB services shall have policies and procedures that include the methods and documentation of medication destruction in accordance with § 44:70:07:06.
