The department shall calculate the fees for tests conducted in the state health laboratory based on the cost of performing the tests.
The fee may not exceed the cost incurred for performing the test or service, including laboratory operation, equipment, and maintenance. Fees to cover the cost of testing requested as part of an emergency investigation of an outbreak or special study, or expedited testing, shall be communicated with the submitter prior to acceptance of specimens or samples for testing.
