If an applicant does not submit the documentation required by § 44:09:07:03 for a delayed registration or if the Department of Health finds reason to question the validity or adequacy of the statements or the documentary evidence, the delayed certificate of marriage may not be filed. The applicant shall be advised of the denial of the application and the right to an administrative hearing and judicial review pursuant to SDCL chapter 1-26.
