Section 41:06:01:18 - Authorization for terminally ill residents to hunt deer, antelope and turkeys
The secretary may authorize a resident who has been diagnosed by a licensed doctor of medicine to have a terminal illness that to a reasonable medical certainty is expected to substantially shorten the resident's life expectancy to hunt deer, antelope, or turkey. Hunting as so authorized shall take place during established hunting seasons unless the persons illness has advanced to a point which justifies the secretary to authorize the person to hunt outside established seasons. A resident under the age of twenty-six who has been diagnosed by a licensed doctor of medicine to have cancer or other life-threatening illness is eligible to receive such authorization. Authorization to hunt issued pursuant to this section shall allow the resident to take no more than one deer, one antelope, and one turkey and shall be issued on a once-in-a-lifetime basis for each species for which authorization is requested. The secretary may waive certain restrictions related to the hunting season or impose additional terms and conditions as necessary to facilitate participation by the resident.
