Upon receipt of a petition the commission shall set a date for a contested case proceeding and shall publish notice of the proceeding in accordance with SDCL 1-25-1.3 and SDCL 1-26-17. The notice shall be published in at least three local newspapers prior to the proceeding. This proceeding shall be considered a contested case proceeding as defined by SDCL 1-26-1. After a contested case proceeding, the commission shall adopt a resolution to grant, deny or modify the petition stating the reasons for partial or complete denial pursuant to SDCL 41-23-9.
