No person may operate a boat loaded beyond the maximum number of persons, weight capacity or a combination thereof as stated on the capacity plate and affixed to the boat by the manufacturer, nor may a person operate a boat powered by an inboard or attached outboard motor where the total horsepower of the motor exceeds the total horsepower rating as stated on the capacity plate and affixed to the boat by the manufacturer.
