The royalty rate for a lease to remove sand, gravel, or other material shall be set by the commissioner for each lease or extension of a lease. The royalty rate shall not be less than 10 percent of the market value of the material removed, at the time it is sold or processed by the lessee. Royalty payments shall be made by the tenth of each month.
