An individual may petition for a royalty increment status lease by filing a completed petition form. The petition form shall be obtained from the commissioner. Within 30 days after receipt of a completed petition, the commissioner shall set the time and place for a hearing pursuant to SDCL chapter 1-26 and shall notify the petitioner. The petitioner shall notify all mineral interest owners and lessees within one mile surrounding the leased area of the petition and hearing at least 15 days before the hearing.
