To conform with the requirements of the Family Educational Rights and Privacy Act, 20 U.S.C. § 1232g, 34 C.F.R. Part 99 (March 8, 2012), the department shall use a minimum group size of ten students for each student group of § 24:55:01:05 when publicly reporting accountability results. If a student group has fewer than ten students, that group's accountability results may not be publicly reported. The department may not report student group results if all of the students in a group have the same student achievement level as defined in § 24:55:01:04(4).
